Jacob Flanagan, 21, of New York, NY, burglary, three counts, theft by unauthorized taking or transfer, all dismissed; criminal trespass, $400 fine.

Talicia Martins, 22, of New Haven, Conn. Martins was convicted on a single count of theft March 28. A second count of theft and three counts of burglary were dismissed. She was sentenced to an alternative sentencing program, to begin Oct. 25, for a single theft conviction.

The alternative sentencing program offers first and second offenders an alternative to incarceration in a county jail, according to information provided by the Knox County Courthouse. Martins will cover the cost of the program, which can range from $300-$500. The program is held each fall and spring at Wavus Camp in Jefferson and a defendant can only be sentenced to the program by a judge, or recommendation by the attorney.

Both have been ordered by the court to pay $4,663 in restitution to the business owners.

The two had followed the terms of their deferred disposition agreements reached a year ago with the state.

The pair were originally arrested by police in July 2017 for break-ins at Camden Cone, Francine Bistro, and the Smoothie Shack in Camden.

They were individually charged with three counts of burglary and felony theft at their initial court appearance Jan. 22, 2018.

The state and the attorneys for the pair had reached a plea agreement for a deferred disposition agreement during a hearing held in Knox County Unified Court March 29, 2018. Both have been in substance abuse programs and have refrained from any further criminal conduct, according to court documents.

The agreement for Martins stipulated that if she continued substance abuse counseling and provided proof to the state and refrained from additional criminal conduct for the next 12 months, she would be sentenced to 364 days in jail with all but 35 days suspended. The 35 days was a cap, allowing her attorney to argue for a decreased jail sentence. She would also be placed on probation for a year following her release.

If Martins adhered to the deferred disposition, one of the burglary charges would be dismissed as part of the agreement, the second charge would be amended to a misdemeanor and a third burglary count would be filed as criminal trespass charge.

Flanagan's agreement included for him to serve 21 days in jail if he abided by the same terms defined in Martins’ agreement during the next 12 months. Two burglary charges would also be dismissed and a criminal trespass charge would be filed for the third burglary charge if he adhered to the agreement.

Both were also prohibited from using drugs or alcohol during the 12 months of the agreement and were subject to random searches and testing for drugs. They each paid a $25 monthly administrative fee.

If the terms of the agreement are violated, it will be considered void and the pair will be sentenced as charged.
