Lawsuit alleges that sewer was improperly connected

Camden files lawsuit against developer of subdivision

    ROCKLAND — The Town of Camden filed a civil suit Feb. 19 in Knox County Sixth District Court, alleging that the developer of a residential subdivision did not properly install a permanent sewer connection to the town's sewer line, a condition outlined in the plan that was filed with the town.

    Mountain Arrow Village Green Inc. and Mountain Arrow LLC were named as defendants in the lawsuit.

    The lawsuit was filed after the Select Board met with town attorneys in a closed session on Feb. 3.

    According to court documents, Mountain Arrow Village Green Inc. and Mountain Arrow LLC failed to follow the plans first approved by the Planning Board in 2008 for the 13-lot subdivision. Included in the plan was the condition that the subdivision would be temporarily served by an existing sewer connection on a neighboring lot and then connected to the main sewer line on Route 1 when the Maine Department of Transportation lifted their moratorium on this type of construction.

    The suit further states that the developer never deposited $18,750 into an escrow account to guarantee that the connection would be completed after the moratorium was lifted.

    The town is seeking that the court approve fines of $100 and $2,500 per day, beginning on the date the suit was filed, as well as reimbursement of legal fees. The lawsuit also seeks an injunction to cease the use of the temporary sewer line and to connect all of the lots in the subdivision to the main sewer line on Route 1.

    Attorneys William Kelley and Kristin Thomas are representing the town in the lawsuit.
